A child travelling abroad with a grandparent: the parental consent you need for temporary protection

A typical story from our inbox. A grandmother is taking her granddaughter to Spain while the parents stay in Ukraine. A notary has drawn up a travel consent and the birth certificate has already been sent for an apostille — and then it turns out that this consent is not enough for temporary protection, and that the certificate is laminated, so it cannot be apostilled. Here is how to get the documents right the first time.

Two different statements: one for the border, one for life abroad

A travel consent (for crossing the border) is a short statement by the parents: the child leaves with a named person for a named country and period. It is shown at the border and is usually not apostilled.

An extended statement — consent to travel and to day-to-day care. It is needed when the child will live abroad without the parents and documents will have to be arranged there: temporary protection, school, a doctor, registration. To apply for temporary protection on the child’s behalf, the adult must show that they are the child’s legal representative with the right to care for the child. This is the statement that is then apostilled and translated into the language of the country.

Why it matters. If a child arrives without the parents and the adult cannot prove their authority, the foreign authorities may treat the child as unaccompanied — with prosecutors and child-protection services involved. An extended statement settles this.

Who signs it

Both parents. If one parent is absent, the other signs, and the statement is accompanied by a document explaining why:

  • a death certificate;
  • an extract from the State Civil Registry — if the mother is registered as a single mother (the father’s details entered under Article 135(1) of the Family Code);
  • a court decision terminating parental rights.

If the father is now entered in a duplicate birth certificate while the mother was earlier registered as single, check what the civil registry record currently says before going to the notary.

What the statement should cover

  • the country (and transit countries) and the period of stay;
  • details of the child and the accompanying adult;
  • the adult’s powers: choosing the place of residence, registration, school and kindergarten, doctors and medical treatment, obtaining documents, consular registration, temporary protection;
  • the obligation to bring the child back to Ukraine at the end of the period.

Sample statement

Below is the sample we share with clients. A Ukrainian notarial statement is drawn up in Ukrainian, so the sample is in Ukrainian too. The notary may adjust the wording to your situation; the father signs an identical statement (or both parents sign one joint statement).

Birth certificate: a laminated one will not do

An apostille goes only on an original without lamination. Civil registry offices have long been barred from laminating certificates, yet some still do — and such a document will not be accepted abroad, not even by a school. The solution is a duplicate birth certificate: any civil registry office in Ukraine issues it, and a grandparent can obtain one for a grandchild without a power of attorney from the parents. The same right — no power of attorney needed — belongs to the child’s adult siblings, aunt, uncle, stepmother and stepfather; this is set out in the Ministry of Justice Order No. 3734/5 of 3 September 2022 (in force for the duration of martial law) (in Ukrainian). More in why a laminated document cannot be apostilled.

Apostille and translation

For Hague Convention countries — Spain, Italy, Germany and others — the notarial statement and the birth certificate receive a Ministry of Justice apostille. The documents are then translated into the language of the country together with the apostille, and a notary certifies the translation. Some institutions require a translation by a translator accredited in their own country, so check the requirement before ordering a translation. The apostille is placed in Ukraine either way.

No need to travel to Zhytomyr: you send the originals by Nova Poshta and we return the finished documents the same way. Send photos of the documents on Telegram and tell us which country the child is going to — we will tell you exactly what your case requires.
